ACTION PLATFORM OF THE AMAZONIAN INDIGENOUS PEOPLES (AIDESEP)

April 24, 2009 | Campaign Update

1. Repeal of all legislative decrees and laws that impinge upon the rights of indigenous peoples. These laws include Law 29317 that modifies Legislative Decree 1090 also known as the NEW FOREST AND WILDLIFE LAW, Law 29338, the Water Resources Law, and Legislative Decrees 1089, 1064 and 1020.

2. Reform of the Peruvian Constitution to reintegrate indigenous territorial rights (inalienable, imprescriptible, non-seizable), and constitutionalizing the United Nations Universal Declaration on the Rights of Indigenous Peoples and the Convention 169 of the International Labor Organization.

3. Immediate recognition and granting of land titles to indigenous communities. Recognition of collective territorial property. Restitution of the legal attributes of regional PETT (i) offices. Granting land titles to indigenous communities whose territories are to be found within Protected Natural Areas. Expansion of the Ichigkat Muja National Park to incorporate the ancestral territories of the Awajun previously excluded solely to benefit mining and oil companies in the Cenepa region.

4. Recognition as Territorial Reserves those territories of indigenous people who live in voluntary isolation or initial contact. Approval of AIDESEP (ii) proposals relating to these territories.

5. Suspension of all territorial concessions of indigenous lands to companies or individuals for the exploration or exploitation of oil or minerals, tourism, timber or other uses.

6. An immediate solution to the demands of regional organizations FENAMAD (iii), ORPIO (iv), CORPI SL (v), ORPIAN (vi), COMARU (vii), ARPI SC (viii) and ORAU (ix) . An immediate solution to the problems caused by gold mining in the Cenepa and Madre de Dios regions.

7. Repeal of those norms that authorize Free Trade Agreements with the United States, the European Union and Chile to infringe upon indigenous territorial rights, the intellectual property of our collective knowledge, and endanger our Amazonian biodiversity.

8. Implement a reform of the State that incorporates INDEPA (x) as an OPD (xi) with ministerial status that includes the creation of the posts of Deputy Intercultural Health Minister and Intercultural Education Minister, and, through these changes creating genuine intercultural universities.

9. Establish a NATIONAL DISCUSSION FRAMEWORK to work on the problems faced by indigenous peoples, with legal representation of both the State and Peruvian indigenous organizations.
